Lead Acid Batteries and Used Motor Oil will be accepted for proper disposal. Notify Gatekeeper for location to dispose of these items. Paint - Take the lids off and let it dry out in a well ventilated area. As long as the paint can is dried out, you can put it in the trash. You can also spill the paint on old carpeting, let it dry, and then take it to the landfill. Sarpy County and Omaha also have paint swap locations where you can take the paint to that location. Bellevue works in conjunction with the Omaha Paint Swap day and provides a site in Bellevue. You can also contact the Sarpy County Extension Office for paint kits. 1. Library cards are free to residents of the City of Bellevue and their dependents for any person who pays property taxes to the City of Bellevue. 2. Because the library is funded by property taxes, which is only paid by Bellevue residents, nonresidents are required to pay a minimal fee for library cards. The costs are: a. $25.00 annually for a family membership. b. $ 5.00 annually for an individual student, Grades K - 12. c. There is a $1.00 fee to replace a lost card (both resident and nonresident) 3. Hours for the library are: Monday thru Thursday 9 a.m. to 9 p.m.; Friday and Saturday 9 a.m. to 5 p.m. Sunday 1 p.m. to 5 p.m. 4. If materials (other than videos or art prints) areoverdue longer than 4 days, there is a $.10 a day fine per item. 5. Video and art print overdue fees are $1.00 per day. 6. Library privileges are suspended for all members of a household if the overdue or lost book charges for any one family member exceeds $24.99. 7. If overdue and/or lost book charges exceed $49.99 for any individual, the matter is referred to the City Attorney's office for further action. MAILBOX INSTALLATION - Sample Letter to Residents Dear Resident: Each year during snow removal, some residents are inconvenienced because city crews inadvertently damage their mailboxes. During a check of the area, we have determined that yourmailbox is placed too near the street on the city right-of-way. We are advising you now to give you ample time to relocate your mailbox prior to snow removal next winter. Please position your mailbox to conform to the following drawing. If you move your mailbox to conform to the drawing, please notify the Street Department at 293-3126. At that time, we will accept responsibility for damages caused by the snow plow. The property owner is still responsible to have a properly sized post and have the mailbox securely fastened to the post. I have conferred with the Post Office and they agree that mailboxes placed according to the drawing are acceptable. Any trash hauler in the city must be licensed. Fee is $25 a year. (Section 13-64, Bellevue City Code) 3. Any ice cream vendor from a motor vehicle must be licensed. Fee is $50 a year, and he may not make any noise to attract customers such as ringing a bell, music, etc. (Section 23-27, Bellevue City Code) 4. All beekeepers must get a permit from the City Clerk upon payment of a $20 fee. Permit is good until the applicant discontinues or alters the beekeeping activity. (Section 6-116, Bellevue City Code) 1. A mini bike is an off-road vehicle and may not be ridden on the public streets unless during an emergency or while used in a parade. (Nebr. State Statutes 60-2101.01 to 60-2102) 2. No person shall operate a moped upon the streets, alleys, or public highways of Nebraska unless such person has (1) a valid motor vehicle operator's license or (2) a valid school learner's permit. (Nebr. State Statutes 39-6,197) 3. No person, other than employees in the course of their work, shall ride or drive any motorized vehicle, automobile, motorized cart, moped or motorized bicycle on any footpath, sidewalk or any area other than the designated roadway for the use of such vehicles. Use of minibikes and like vehicles not licensed for operation on state roads is completely prohibited either on or off roads, in all parks and playground areas. (Section 21-15, Bellevue City Code) (Section 19-60 to 19-72, Bellevue City Code) 1. It is unlawful for any person to make any loud, unnecessary or unusual noise which either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others within the city. Included, but not limited to: radios, phonographs; yelling, shouting, animals, birds, exhausts, defective vehicles, building construction and repair, drums, pile drivers, hammers, and blowers. Building construction noise is permitted from 7 a.m. to 6 p.m. Other noises, such as radios, etc. that to not disturb the peace of others are permitted from 7 a.m. to 11 p.m. (Section 28-111 to 28-133, Bellevue City Code) 1. It shall be unlawful for any person to organize or hold or participate in any parade, meeting, assembly or procession of persons and/or vehicles on the streets, sidewalks or other public places within the city unless such activity shall have first been authorized by a written permit. 2. Information on getting a permit may be obtained from the City Clerk, 210 West Mission, phone: 293-3007. PARKING - FRONT, SIDE AND REAR YARD VEHICLE PARKING (Ordinance #2687): 1. The parking of vehicles shall be prohibited in the front yard, side yard or rear yard (except on a driveway) unless the vehicle is parked on an asphalt, concrete or other approved hard surface slab, a minimum of 162 square feet. A Recreational vehicle,boat or trailer may be parked in the side or rear yard if it is not nearer than 2' from the lot line; or on a concrete driveway if space is not available in the rear yard or side yard; or there is no reasonable access to the rear yard. PARKING - RECREATIONAL VEHICLE, TRAILER AND BOAT PARKING AND STORAGE (Section 18-76, Bellevue City Code) 1. Parking is permitted in any enclosed structure which conforms to the zoning requirements. 2. Parking is permitted outside in the side or rear yards, provided it is not nearer than 2 feet to the lot line. 3. Parking is permitted outside on a concrete driveway, provided: Parking - RV, Trailer and Boat (Continued) a. Space is not available in the rear or side yard or there is no reasonable access to either the side or rear yards. A corner lot is always deemed to have reasonable access to the rear yard and a fence or hedge is not necessarily deemed to prevent reasonable access; b. Inside parking is not possible. c. The unit is parked perpendicular to the front curb. 4. The body of the recreational vehicle or boat must be at least 15' from the face of any curb, and no part of the unit may extend over the public sidewalk or right-of-way. 5. Parking is only permitted for storage purposes and the recreational vehicle or trailer shall not be: a. Used for dwelling purposes, except for overnight sleeping for a maximum of 14 days in any year. Cooking is not permitted at any time. b. Permanently connected to sewer, water or electricity. The recreational vehicle may be connected to electricity temporarily for charging batteries and other purposes. 6. A unit may be parked anywhere on the premises during active loading or unloading, and use of electricity or propane fuel is permitted when necessary to prepare a recreational vehicle for use. 7. The unit shall be owned by the resident on whose property the unit is parked for storage. PARKING - LONG AND CONTINUOUS: (Section 18-66, Bellevue City Code) 1. No owner of any motor vehicle shall use the streets or other public thoroughfares of the city for long and continuous parking when such use interferes with traffic or maintenance of public thoroughfares to the extent of becoming a nuisance. 2. The owner of any such vehicle shall remove the same upon notice, in writing, by the Police Department within 24 hours. Upon failure to obtain the order of such officers, the vehicle(s) shall be ordered impounded as a nuisance, and the owners required to pay necessary costs and storage. PARKING - ON NARROW STREETS: (Section 18-91, Bellevue City Code) 1. The Chief of Police is hereby authorized to designate the location of signs indicating no parking upon any street when the width of the roadway does not exceed 20' or upon one side of a street as indicated by such signs when the width of the roadway does not exceed 30'. 2. When official signs prohibiting parking are erected upon narrow streets as authorized herein, no person shall park a vehicle upon any such street in violation of any such sign. 3. The City of Bellevue's policy is to ban parking on the north and east sides of streets, and allow parking on south and west sides of streets that are less than 30' but more than 20' in width. PARKING - OBSTRUCTING DRIVEWAYS, ALLEYS, etc. (Section 18-87, Bellevue City Code) (Section 39-672, 39-673 Nebraska State Statutes) 1. No operator of any motor vehicle, whether the vehicle is attended or not, shall park on any street or highway within the city, in any manner that would interfere with ingress and egress of any private driveway, established alley; or in the lane of traffic proceeding in the opposite direction; or within 2' on either side of the opening of any private driveway, public driveway or established alley. 2. No person shall park any motor vehicle: a. Within 15' of any fire hydrant. b. Within 30' of any flashing signal, stop sign, yield sign, or other traffic control device located at the side of a roadway. c. Within 20' of a crosswalk at an intersection. d On the roadway side of any vehicle stopped or parked at the edge or curb of a street, highway or roadway. e. On a sidewalk. f. Within 20' of the driveway entrance to any fire station; and on the side of street, highway or roadway opposite the entrance to any fire station within 75' of such entrance when properly signposted. g. Along any curb line painted red or yellow. h. Within 30' of points on the curb immediately opposite the closest end of a safety zone. I. Within any intersection of a street, highway, or roadway or sidewalk area to in any manner interfere with the use thereof by the public. 3. All vehicles parked upon a two-way roadway must be parked with the flow of the traffic. No parking is allowed facing the flow of traffic. (Section 39-673, Nebraska State Statutes). 4. No person shall park a vehicle upon any roadway for the principal purpose of displaying such vehicle for sale; or greasing or repairing such vehicle except repairs necessitated by an emergency. (Section 18-95, Bellevue City Code) 1. It shall be unlawful for any person to park a truck, semi-trailer, tractor or truck tractor with a five-ton license certificate or plate and which exceeds 8' in width or 21' in length on any street within the city except for that period of time necessary for loading and unloading, delivery or collection of goods, wares and merchandise, but in no event shall this time period exceed 2 hours. PARKS (Ordinance 1145, 1030): 1. Unless posted, all parks are closed to the public at 10.00 p.m. (Section 21-23, Bellevue City Code) 2. No alcoholic beverages are permitted in the parks. A waiver may be granted by the Park Department to consume alcoholic beverages in the shelters in Haworth Park only. 3. A request to consume alcoholic beverages in Haworth park, must be made at the Park Department, 206 Industrial Drive, phone: 293-3122. A $20 fee is charged and only with shelter rental. 4.A docking permit for the use of the public launch at Haworth Park is available from the Parks Department for $15 for the season May 1 thru October 31 or $3 per launch.. 5. A 200 slip marina in Haworth Park is available. Season rates from April 15 thru October 15th are $475 for boats under 20' plus $25 deposit for keys and cards; $575 for 20' boats; $675 for 28' boats; and $775 for boats 32' and above, plus $25 deposit for keys and cards. Water is available to all slips, and electricity is available to the 24', 28' and 32' slips. Temporary berthing of boats for four hours or less ($4) or overnight ($10) will be allowed in the Marina if space is available. 6. Overnight camping is available at Haworth Park for the following fees: a. $15.00 per night for a camper or trailer (includes water and electricity). b. $ 7.00 per night for a tent (includes water and electricity). 7. Theshelters in Haworth park are available for rental from the Park Department, 293-3122. Fees are $20 for first three hours, $10 for each additional hour, and $20 for an alcohol permit. 8. A multitude of recreational and parkactivities are available during the spring and summer months. These include swimming (see below); tennis league and lessons; baseball and softball leagues; day camp and nature study seminar, basketball program, Track Club, football program. Music in the Parks will be performed every Thursday at 7:30 in Washington Park during the summer. 9. The Reed Community Center, 293-3142, is available for wedding receptions, anniversaries, and banquets for up to 200 persons. Other activities at the Reed Center are square dancing, tumbling, arts and crafts, Tai-Kwon-Do, tap, ballet, cheerleading, and various senior citizen activities. 10.No groups in excess of 15 people shall hold picnics, meetings or other gatherings in the public parks without applying in advance to the Park Superintendent, 293-3122 and leaving the name, address and telephone number of the person responsible for cleanup. (Section 21-12, Bellevue City Code). 11. No person shall preach aloud or make any speech or oration to any group of three (3) or more people in a park without special permit from the City. Permits may be obtained from the City Clerk, 293-3007, on forms approved by the Council. (Section 21-11, Bellevue City Code) 12.No person shall carry any rifle, gun, bow and arrow or other weapon of any kind within the parks and playgrounds of the city; nor shall any person fire, discharge or set off any rocket, cracker, torpedo, squib or other firework or anything of an explosive nature without special permission from the City Clerk. (Section 21-4, Bellevue City Code) 13. No person shall ride or drive any motorized vehicle, automobile, motorized cart, moped or motorized bicycle on any footpath, sidewalk or any area other than the designated roadway for the use of such vehicles. Use of minibikes and like vehicles not licensed for operation on state roads is completely prohibited either on or off roads, in all parks and playground areas. (Section 21-15, Bellevue City Code) 14. Power driven model airplanes and cars may not be operated in any park, playground or parking area unless such areas shall be set aside and so designated by the park superintendent. PERMITS AND INSPECTION REQUIREMENTS: (1991 Uniform Administrative Code) For more detailed information, go to the permits page (click here) Permits Required: No building or structure regulated by the PERMITS AND INSPECTION DIVISION for the CITY OF BELLEVUE and the two mile jurisdiction shall be erected, constructed, enlarged, altered, repaired, improved, removed, converted or demolished, unless a separate permit for each building or structure has first been obtained from the BUILDING OFFICIAL. 1. One story detached accessory buildings used as tool and storage sheds, playhouses and similar uses, provided the projected roof area does not exceed 120 square feet. 2. Oil Derricks. 3. Movable cases, counters, and partitions not over 5 ft 9 inches high. 4. Retaining walls not over 4 feet in height measuring from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding flammable liquids. 5. Water tanks supported directly upon grade if the capacity does not exceed 5000 gallons and the ratio of height to diameter or width does not exceed 2 to 1. 6. Replacement of concrete or asphalt driveways and walks provided that the area being replaced is no larger than that which previously existed, or that it does not go over any basement or story below. 7. Painting, papering, floor covering and similar finish (cosmetic) work. 8. Temporary motion picture, television and theater stage sets and scenery. 9. Window and door awnings supported by an exterior wall of a single family dwelling or garages when projecting not more than 54 inches. 10. Swimming Pools: Prefabricated swimming pools accessory to a single family dwelling in which the pool walls are entirely above the adjacent grade and if the capacity does not exceed 5000 gallons. UNLESS OTHERWISE EXEMPTED separate PLUMBING, MECHANICAL AND ELECTRICAL permits will be required for the above items. Plumbing Work Not Requiring A Permit: No permit shall be required in the case of any repair work as follows: The stopping of leaks in drains, soil, waste or vent pipe, provided, however, that should any trap, drainpipe, soil, waste or vent pipe be or become defective and it becomes necessary to remove and replace the same with new material in any part or parts, the same shall be considered as such new work and a permit shall be procured and inspections made as provided. No permit shall be required for the cleaning of stoppages or the repairing of leaks in pipes, valves, or fixtures, when such repairs do not involve or require the replacement or rearrangement of valves, pipes or fixtures. Mechanical Work Not Requiring a Permit: 1. A portable heating appliance, portable ventilating equipment, portable cooling unit or portable evaporative cooler. 2. A closed system of steam, hot or chilled water piping within heating or cooling equipment regulated by this code. 3. Replacement of any component part or assembly of an appliance which does not alter its original approval and complies with other applicable requirements of this code. 4. Refrigerating equipment which is part of the equipment for which a permit has been issued pursuant to the requirements of this code. 5. A unit refrigerating system. Electrical Work Not Requiring a Permit: 1. Portable motors or other portable appliances energized by means of a cord or cable having an attachment plug end to be connected to an approved receptacle when that cord or cable is permitted by the ELECTRICAL CODE. 2. Repair or replacement of fixed motors, transformers or fixed approved appliances of the same type and rating in the same location. 3. Temporary decorative lighting. 4. Repair or replacement of current-carrying parts of any switch, contractor or control device. 5. Reinstallation of attachment plug receptacles, but not the outlets. 6. Repair or replacement of any overcurrent device of the required capacity in the same location. 7. Repair or replacement of electrodes or transformers of the same size and capacity for sign or gas tube systems. 8. Taping joints. 9. Removal of electric wire. 10. Temporary wiring for experimental purposes in suitable experimental laboratories. 11. The wiring for temporary theater, motion picture or television sets. 12. Electrical wiring, devices, appliances, apparatus or equipment operating at less than 25 volts and not capable of supplying more than 50 watts of energy. 13. Low-energy power, control and signal circuits of Classes II and III as defined in the ELECTRICAL CODE. 14. A permit shall not be required for the installation, alteration or repair of electrical wiring, apparatus or equipment or the generation, transmission, distribution or metering of electrical energy or in the operation of signals or the transmission of intelligence by a public or private utility in the exercise of its function as a serving utility. To obtain a permit, the owner or agent shall file an application in writing on a form furnished by the Permits and Inspection Division for that purpose. Each applicant Shall: 1. Identify and describe the work to be covered by the permit for which application is made. 2. Describe the land on which the proposed work is to be done by legal description, street address or similar description that will readily identify and definitely locate the proposed building. 3. Indicate the use or occupancy for which the proposed work is intended. 4. Be accompanied by plans, diagrams, computations, specifications and other data as required in this section. 5. State the valuation of any new building or structure or any addition, remodeling or alteration to an existing building. 6. Be signed by the owner or his authorized agent. 7. Give such other data and information as may be required by the Building Official. 8. The Building Official may require plans, computations and specifications to be prepared and designed by an engineer or architect licensed by the State to practice as such. Exception: The Building Official may waive any of these requirements when it is determined that the information is not needed for the plan review. Plan Review Fees: When a plan or other data is required to be submitted, a plan review fee shall be paid at the time of submitting plans and specifications for review. Said plan review fee shall be 25% of the building permit fee. If the applicant obtains said permit within 6 months, the plan review fee may be used as part of the total permit fee. If the applicant fails to obtain said permit within 6 months, the plan review fee shall be retained by the City in all cases. If the applicant wishes to pay the total fee required for a permit at the time of application for same, he/she may do so. However, if the applicant wishes to withdraw the permit application for any reason within 6 months, he/she may do so. In all cases, 25% of the total fee required for each permit shall be retained by the City as a plan review fee. 1. All outdoor swimming pools shall be completely surrounded by a fence or wall not less than 72 inches in height, which shall be constructed as not to have openings, holes or gaps larger than 4 inches in any dimension except for doors and gates. (Zoning Ordinance #2694) 2. The city has 6 swimming pools. They are: a. Sorensen Pool, 2602 Sidney Street b. Dowding Pool, 14th & Washington Street c. Cascio Pool, 1500 Lawrence Lane d. Jerry Gilbert Pool, 29th & Jackson e. Sun Valley Pool, 53rd Street & Arrowrock Drive f. Fontenelle Hills Pool, 1102 Country Club Court Generally the pools open when school closes for the summer and close before school starts in the fall.Pool passes may be purchased at the Reed Community Center, 1200 Lord Blvd. 293-3142 Daily swim fees are: Youth (18 years & under) $ 1.50 Adult (19 years & over) $ 2.00 Wading pool (2 yr-Adult) $ 1.00 Season Swim Passes are: Youth Pass $25.00 Adult Pass $30.00 Family Pass $60.00 Pool Parties $50.00 AMATEUR RADIO TOWERS: Amateur radio towers and associated antennas which are licensed as amateur radio operators by the Federal Communication Commission are allowed in any zone up to a maximum of 75'. (Zoning Ordinance #2683) (Section 30-137, Bellevue City Code) 1.Sewer rates are $4.46 for the first 1500 gallons of water and $1.42 for each additional 1000 gallons used. 200.52 cubic feet = 1500 gallons of water; and 133.68 cubic feet equal 1000 gallons of water. Sewer use rates are established during the winter months of December, January, February and March. The succeeding months are based on that average or actual usage whichever is lower. 2. Sewer charge is included on your water bill from MUD. 3.Sewer backups should be reported to the wastewater department at 293-3135. Residents are responsible for clearing any sewage lines connecting to the main sewer lines. PROCEDURE FOR APPLICATION FOR PRIVATE SEWAGE DISPOSAL SYSTEMS: Application: 1. A percolation test shall be submitted for approval, in conjunction with the application and site plan. The percolation test shall be done in accordance with the State of Nebraska regulations, Title 124, "Rules and Regulations for the Design, Operation and Maintenance of Septic Tanks", and shall be done by a licensed Registered Professional Engineer or an approved testing laboratory. 2. The review of the design criteria shall be in accordance with the rules and regulations as stipulated in the Code of the City of Bellevue, and the adopted version of the Uniform Plumbing Code, appendix I, or Title 124, whichever is more restrictive. a. It is the responsibility of the professional engineer or approved testing laboratory to design a private sewage disposal system that meets the minimum requirements established in Appendix I, Tables I-2 through I-5 of the Uniform Plumbing Code or Title 124, whichever is more restrictive. b. Once the percolation test and the design of the private sewage disposal system have been submitted, the documentation and design shall be reviewed for compliance with the Uniform Plumbing Code, appendix I, or Title 124. Sewer (Continued): c. The City of Bellevue requires that a parcel of land must contain a minimum of one-half acre for consideration of a private sewage disposal system. Approval or Denial: 1. If the submitted documentation meets the minimum requirements of the Uniform Plumbing Code or Title 124, the reviewer shall sign off on the application and return the documentation to the Permits and Inspections Technician for issuance of a permit. If the documentation submitted is found to be in error, the applicant shall be notified of such and new documentation shall be submitted in accordance with the Uniform Plumbing Code and Title 124. When Connection to the Public Sewer is Required: The owner of all houses, buildings or properties used for human employment, recreation or other purposes situated within the city and abutting any street, alley or right-of-way in which there is now located or may in the future be located a public sanitary or combination sewer of the City, is hereby required at his expense to install suitable toilet facilities therein and to connect such facilities directly with the proper public sewer in accordance with the provisions of this article within ninety (90) days after the date of official notice to do so provided that said public sewer is not located more than two hundred (200) feet from any proposed building or exterior drainage facility on any lot or premises which abuts and is served by such public sewer. (Section 28-27, 28-32 and 8-23 Bellevue City Code) 1. Every owner shall keep and maintain the sidewalk along his property in good and proper repair and in a condition reasonably safe for travel. 2.The City of Bellevue will not issue a building permit for a new building or to add square footage onto an existing building unless the plans provide for the construction of a sidewalk or a waiver of the sidewalk requirement has been granted from the Public Works Director. 3. No person shall erect, maintain or suffer to remain on any street or public sidewalk or on any other portion of the area between the lot line and the curb line of any street, any stand, wagon, OR OTHER OBSTRUCTION injurious to, inconvenient or inconsistent with the public use of the same. SIGNS The City has a very comprehensive sign ordinance requiring a permit, regulating size, etc. Please check with the Planning Department, 293-3026 or Permits & Inspection, 293-3015 if you have any questions on signs. Some rules on signs affecting residential neighborhoods are as follows: 1. Political Signs cannot exceed 6 square feet in any zone; only four political signs are allowed on any lot at any time. Political signs shall not be erected more than 30 days before an election and must be removed no later than 14 days after an election. 2. Temporary Freestanding Signs/Garage Sale Signs mean a "temporary sign with a post or other support structure designed to be inserted into the ground for use of the sign on a temporary basis." Such signs normally include real estate signs, and only two signs shall be allowed per lot at any one time. The sign face may not exceed 6 square feet in any residential zone and 32 square feet in any other zone. All temporary freestanding signs may only be exhibited for not more than 60 days. As with all other signs, they are not permitted in the public right of way. 3. Community Event Signs are "exhibited in conjunction with special events such as a philanthropic campaign or church, circus, carnival, school, or other community activity". These signs shall not exceed 100 square feet in area and shall not be erected more than fourteen (14) days before and shall be removed no later than fourteen (14) days after the holiday, event, or celebration. 4. Signs in Public Right-of-Way With few exceptions, no signs shall be allowed in any public right-of-way. Any sign placed in the public right-of-way is subject to confiscation, and the city shall have the right to recover from the person placing the sign the full cost of the removal and disposal of the sign. The publicright of way, as defined by state statute, means any land, property or interest therein, usually in a strip, acquired for or devoted to a road, street or highway. What this means is that any land within a roadway, such as a median, or strips of land adjoining a street, are public right of ways. For Bellevue residential areas, this usually means the land within 12 1/2 feet of the curb. For larger roadway, like Harvell Drive or Fort Crook Road, the right of way extends for longer distances. 5. Garage Sale Signs Same as Temporary Freestanding Signs. (Section 18-11, Bellevue City Code) 1. No person upon roller skates, or riding in or by means of a coaster, toy vehicle or similar device, shall go upon any roadway except while crossing a street on a crosswalk and when so crossing such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This section shall not apply upon any street while set aside as a play street as authorized by ordinance of this city. (Sections 28-134 to 28-138, Bellevue City Code) (Sections 18-97 to 18-100, Bellevue City Code 1. The owner or occupant of any real property, (whether a tenant, lessee or owner) in the City shall keep the sidewalks adjacent to their property clear of snow, ice, mud and slush. Sidewalks must be cleared as soon as is reasonably possible, and must be removed within 24 hours after the end of any storm or snowfall. 2. If any sidewalk is not cleared by the owner or occupant as required, the city may clear the sidewalk and levy a lien against the property for the costs. 3. It is unlawful to push any snow, ice, mud or slush into the street. 4. If conditions warrant, the City may declare a snow emergency and prohibit parking on all of, some of, or any part of the streets within the city. A bare pavement policy is the goal of the Street Department. Goal is to clear all the streets within 8 hours of the storm's end (on a storm of 10 inches or less). The city's salt supply is stored in enclosed buildings to protect the environment. The city uses a mixture of 3 parts sand and 1 part salt to provide traction and melt ice and snow. The city clears the snow from curb to curb. Any cars parked on the street should be moved within 24 hours to allow for snow removal. (If possible park all vehicles off the street until the plows are finished. This will keep your driveways from being plowed shut again during re-plowing). The city is divided into 24 plow areas with 1 plow assigned to each area and all areas are plowed simultaneously. The city has crews on duty or on call 24 hours a day, 7 days a week during the snow season. While the storm is in progress, we normally have an on-call crew on duty (approximately 13 plows) to keep the main routes and hilly areas passable. At the end of the storm the plows open all thoroughfares and highways and then begin plowing in the residential areas immediately. The plows make a single pass through their entire area and then return to make the curb passes. If possible, do not clean the end of your driveway until the curb passes have been completed. This will keep you from having to shovel your drive more than once. Mailboxes should be installed a minimum of 4 inches behind the back of the curb. Should an approved mailbox be struck directly by a snowplow, the department is responsible for its repair. If an approved mailbox is knocked down from the weight of snow hitting it, the department is not responsible for its replacement. Should a mailbox that is not approved be knocked down, it is the responsibility of the homeowner to repair it. (Section 23-1 to 23-24, Bellevue City Code) 1 Any solicitor to either residential or commercial areas within the City of Bellevue must be licensed by the City Clerk. Licenses are good for 1 year. Police are informed of all solicitors operating within the city. 2. If the individual is selling a product that he has with him and gives to the resident at that time, the license fee is $2.00 for each individual soliciting. 3. If the individual is selling a product that requires the resident to put any money as a down-payment without receiving the goods, the solicitor must furnish the city with a $500 bond and also pay the $2.00 per person license fee. The purpose of the bond is to guarantee the resident will receive the goods he has made the down-payment on. 4. If an individual sells a product out of the back of a truck or vehicle, he must: a. Have permission of the owner of the property to sell there. b. Obtain a license from the City Clerk for $10 per year and $2.00 for every person doing the selling. c. Is not allowed to set up in the street right-of-way. TELEPHONE TAX: 1. A $1.00 per month surcharge is imposed on each telephone line going into the Bellevue E-911 system. In addition the City of Bellevue has imposed a 5% occupation tax on the gross receipts of all persons operating and maintaining a telephone system in Bellevue. Both of these charges will appear on the consumer's monthly telephone bill. 1. The city reserves the right to collect trash from all households. Presently the city has contracted with Papillion Sanitation for this service and they are the only contractor authorized to remove trash, recyclables, and yard waste from single family residences. Apartments with more than four (4) domiciles under the same roof can contract independently for service. Cost for trash collection is $9.65 per month, (homeowner is billed $9.56 and the city pays $0.09 out of recyclable revenue). Homeowner is billed on your MUD water bill along with the sewer charge. Papillion Sanitation is paid $8.65 per household. 2. Each dwelling is allowed five (5) cans, not to exceed 35 gallon capacity nor weigh more than 60 pounds. Plastic bags up to 35 gallons may be used but must weigh no more than thirty (30) pounds. A combination of cans or bags may be utilized. The contractor does not pick up building materials but will accept brush, tree branches and shrubs up to three (3) inches in diameter, cut to four (4) foot length and tied in a bundle no larger than two (2) feet in diameter. 3. All containers must be located within five (5) feet of the public right-of-way, street or alley and must be placed by 7:00 a.m. on designated pick-up day. 4. Collection of trash , recyclables and yard waste is accomplished between the hours of 7:00 a.m. and 7:00 p.m. on normal workdays. There will be three (3) separate trucks making pickups.When a holiday occurs during the week, those customers scheduled for service after the holiday will be served one day later for the balance of the week. When a holiday occurs on a weekend, thee will be no schedule change. 5. The City of Bellevue has implemented a very successful curbside program. Each residence is furnished a blue 18 gallon plastic container to place recyclables in. We recycle aluminum and tin cans, glass food containers, all number 1 and 2 plastic food containers, junk mail, newspapers, magazines, catalogs, phone books, motor oil, and corrugated cardboard. All containers must be rinsed out and all caps or lids discarded. Place newspapers in brown paper bag, junk mail, catalogs, magazines in separate brown bag. Place cans, glass and plastic containers loose in bin. Place newspaper and junk mail bags on top of bin. Cardboard must be cut in 2 foot by 2 foot pieces and placed under bin. Motor oil (2 gallons per week) should be put in a 1 gallon plastic jug or other unbreakable container and marked "Used Oil". Place oil next to trash containers. Place bin out on same day as trash collection. 6. Yard waste is defined as grass, leaves, dead plants and weeds and cannot be placed in with regular trash. Collection is once per week during the months of April thru November. Yard waste must be loose in cans or placed in brown compostable paper bags. No plastic bags allowed. There is no limit on the amount of containers placed out. Containers are not to exceed 35 gallon capacity or weigh more than 60 pounds and shall be marked with the letters "YW", 4 inches or larger. A 90 gallon cart for yard waste only is available for purchase through Papillion Sanitation, phone: 334-3479. 7. Trash and sewer use fees are billed on your MUD water bill except under special circumstances. Currently, the rate for trash and yard waste collection is $9.56 per month. Senior citizens who qualify are allowed $1.00 reduction per month but are limited to ONE (1) trash container per week. A form must be completed by seniors and is available at City Hall. The Wastewater Department, 293-3135 handles any questions or comments concerning trash service or you may contact Papillion Sanitary at 339-7800 directly. 8. The city, thru the Street Department, 293-3126, provides two free city-wide cleanups every year. At this time residents may bring to three designated areas - 29th & Hancock, 8252 Cedar Island Road, and 12805 South 9th St - the following: Household furniture, lawn furniture, storm doors and windows, major appliances, broken toys, bicycles, bed springs and mattresses, tree limbs and brush, construction material and automotive parts. The following will not be accepted: Automotive oil (can be recycled), tires, hazardous waste, leaves and yard waste. Click here to see the next scheduled cleanup. The city shall notify the owner or owners of any property in the city where there are trees or tree conditions found by examination to be a nuisance and the owner shall have 10 days from the date thereof to abate such nuisance. 2. If not removed or pruned within the 10 day period, the city may remove or prune and the cost of such assessed against the property. 3. No tree planting is allowed on the City rights-of-way. TREES - OVERHANGING TREE LIMBS AND BRANCHES (Section 28-13, Bellevue City Code) 1. Any tree overhanging a sidewalk must be trimmed to at least 8' above the sidewalk. 2. Any tree overhanging a street or alley must be trimmed to at least 14' above the street or alley. Sample Letter to Property Owner: Dear Property Owner: The city has determined that branches from trees which are abutting or adjacent to streets or sidewalks are in violation of municipal ordinance No. 2024, Section 28-13 of the Bellevue City code. It states: The owner or occupant of any lot, piece or parcel of ground abutting or adjacent to any sidewalk or traveled street or alley over which extend the branches of any trees shall at all times keep the branches or limbs thereof trimmed to the height of at least eight (8) feet above the surface of the sidewalk and at least fourteen (14) feet above the height of the street or alley. Whenever the limbs or branches of any trees extend over sidewalks, streets or alleys contrary to the provisions of this section so as to interfere with the lighting of the street from lamps or with the convenience of the public using the sidewalks, streets or alleys, the city administrator or his designee shall order by certified mail, the owner or occupant to cut or remove and dispose of properly such obstructions within three (3) days after having received a copy thereof stating the height restrictions and stating that the city will do so and charge the costs thereof to the owner or occupant as a special assessment for improvements as provided in this chapter, if such regulation is not complied with. No owner shall permit any growth of noxious weeds, grass and worthless vegetation twelve (12) inches or more in height, or litter or cause or allow litter to be deposited on any lot or ground or any part of any lot in the City of Bellevue. 2. If the owner fails to cut weeds, grass or worthless vegetation or remove litter, the city may contract to have the grass cut or the litter removed and assess the actual cost against the property owner.
